Measure Title: RELATING TO HAWAIIAN HOME LANDS.
Report Title: Hawaiian Homes Commission Act; Beneficiary Negotiations; Leases; Department of Hawaiian Home Lands
Description: Defines “beneficiary consultation”. Prohibits the department of Hawaiian home lands from disposing or extending a general lease to non-beneficiaries, unless there are no applicants seeking to enter into a general lease for the use and occupancy of a tract of Hawaiian home lands. Requires the department to notify beneficiaries through beneficiary consultation prior to the disposition of Hawaiian home lands. Prohibits the department from establishing additional criteria to enter into a general lease with an applicant, under certain conditions. Specifies that the department may grant a license or enter into a general lease, under certain conditions. Allocates the interest or other earnings from the Hawaiian home loan fund and Hawaiian home general loan fund into their respective funds, under certain conditions. Requires the department to submit a quarterly report to the legislature and beneficiaries. Authorizes the department to negotiate with homestead association governed water agencies to maintain water systems prior to other service providers, under certain conditions. (SD1)

Measure Title: RELATING TO ACTIONS FOR QUIET TITLE.
Report Title: Action for Quiet Title; Kuleana Land
Description: Provides that where a quiet title action involves kuleana land, at the request of any defendant at the time the action was brought, the court shall order mandatory mediation with a goal of resolving the dispute, including any issues that might need to be preliminarily established through an action commenced under chapter 668A, HRS. Allows the court to consolidate separate actions commenced by the same plaintiff or multiple plaintiffs for the same real property in interest. Requires the plaintiff in a quiet title action involving kuleana land to bear the costs of required mediation and only recover costs, expenses, or attorney’s fees from the defendant as the court may deem reasonable and equitable under the circumstances.

Description: Prohibits the attorney general from any investigation in connection with and under circumstances during a period of time in which it is clear that the Attorney General’s goals are conflicted with native Hawaiian rights protected by article XII, section 7, of the Hawaii State Constitution and individuals are exercising rights by nonviolent civil disobedience that are protected and granted under the Constitution or state constitution.
